S-W Car Hire AU Rental Terms for travel between 01-Jan-2008 and 31-Mar-2011

Upon confirming that your nominated vehicle is available, a non-refundable deposit will be taken from your credit card in order to secure your booking. In addition to this, the following terms and conditions apply:

Rental Charges
The minimum rental charge is for a period of 24 hours. If the vehicle is returned after the due time, extra charges will be applied. There is a grace period of 59 minutes. Between 1 hour and 1 hour and 59 minutes, a charge of one half of the daily rate will be applied, after which a full day rate will be charged.

What is your responsibility?
When you rent a vehicle from S-W Car Hire, you are responsible for returning that vehicle to S-W Car Hire in the same condition it was in at the start of the rental, with the exception of normal wear and tear. To protect you against any unforeseen circumstances, most S-W Car Hire rates include Collision Damage Waiver (CDW) which provides cover for damages to the S-W Car Hire vehicle and /or Third Party Property.
In the event of damage however, an Accident Damages Excess will apply per incident regardless of fault. This is the amount you contribute towards the loss of, or damage caused to, the S-W Car Hire vehicle and/or Third Party Property. This means that generally all damage up to the limit of the Accident Damages Excess is your responsibility. If the damages are less than the Accident Damages Excess, you are responsible only for the damages.

Generally an Accident Damages Excess (ADE) is $2200.00
The renter may purchase optional Renter Cover Options to increase their level of protection. Levels of cover are available as outlined below and full details will be provided at the rental counter when the renter can make their selection (as long as you comply with the Rental Terms and Conditions).

Refuelling Options
S-W Car Hire provides you with a full tank of fuel when you collect your vehicle and a Refuellling Service is offered for your convenience. You may return the vehicle with less than a full tank of fuel and S-W Car Hire will refuel for you. This refueling service charge will be added to the cost of the rental.

Travel Restrictions
Two Wheel Drive Vehicles can only be driven on sealed/bitumen roads and inside our Limitation Boundaries which are Monkey Mia to the North, Kalgoorlie to the East and Esperance to the South.

S-W Car Hire has car branches in Bunbury,  Busselton, Margaret River & Mandurah & drop off at Perth Airport

Transfer
Vehicles must be collected and returned to our branches. Transfers to and from the branch are not included in the rental price. It is the client's responsibility to get to and from the branch. We can arrange delivery and collection to local airports and most resorts and hotels. Also a drop off service at Perth airport (a fee may apply).

Driver's License and Minimum Age
On pick up of the vehicle a valid, non-provisional, State, Overseas or International licence is required to be presented in person by all people wishing to drive the vehicle. The licence must be in English characters for our staff to read. The minimum age to drive the vehicle is 25 years. With a Overseas or International licence a passport is also needed.

Roadside Assistance
All vehicles come complete with a South West directory and are covered by the RAC 24hour break-down service in the unlikely event of any mechanical problems. The most common use of this service is keys locked in the vehicle.

Baby Seats
Baby seats (must be pre-booked) suitable for children under 4 years of age can be fitted to all vehicles. Cost is $20 each per rental.

Booster Seats
Booster seats (must be pre-booked) suitable for children between 4 and 8 years of age can be supplied for all vehicle models. Cost is $20 each per rental.

One Way Rentals
Cars can be dropped of at Perth airport (Condition & fees apply)

Change of Vehicle
We reserve the right to substitute a comparable vehicle or superior vehicle at no extra cost. This shall not constitute a breach of contract, and does not entitle the renter to any refund.

Traffic Infringements
We reserve the right to charge the renter for any speeding or parking fines, traffic infringements and road toll fines. An additional administration fee of $33 will apply to cover the costs of processing.

Cancellation Fees
Your deposit payable at time of booking being confirmed is non refundable in the event of a cancellation.  In addition to this the following cancellation clauses may also apply:
If cancelled less than 7 days prior to pick up - 50% of Gross Rental
If cancelled on the day of pick up or no show - 100% of Gross Rental
There is no refund for late pick up or early return of vehicle.

Travel Insurance
We strongly recommend that clients ensure they take out the highest level of Travel Insurance.

Credit or charge card charges.
S-W Car Hire requires a credit or charge card (Bankcard, Visa MasterCard Amex or Diners) imprint for each rental with an authorization obtained for the approx amount of the rental plus a bond. Any charge for the hire, fuel & damage to the rental vehicle or for liability to a third part for damage, will be debited to the credit or charge card. This may occur after the rental vehicle has been returned and separately from the debiting of rental charges to the credit or charge card. Normally, the full amount of the Accident Damages Excess (ADE) will be debited to the card and any part of the ADE not required to pay for the damage, (once it has been assessed) or meet liability to a third part will be refunded subsequently.

Your Full Responsibility
The customer will be responsible for additional damages. This includes damages resulting from:
1. Damages resulting from water damage
2. Damages resulting from partial or total immersion in water, where that results from YOUR negligence or recklessness
3. Damages caused deliberately, recklessly, negligently or carelessly (full repair costs)
4. Damages including the cost of repair to the body and/or undercarriage of the vehicle caused by objects overhanging or otherwise obstructing the path of the vehicle (full repair costs).

When taking the vehicle into the following areas, CDW is negated. Therefore S-W Car Hire do not encourage vehicles to be driven/taken to/in these areas as the renter has full responsibility for all damage costs. These areas include:

1. Unsealed roads other than roads under construction.
2. Any beach or otherwise in or exposed to salt water
3. Any areas or regions outside the state of Western Australia
4. Any areas or regions outside S-W Car Hire's Limitations Boundary
5. Any other areas or regions of which you are at any time informed in writing.

When you pick up your vehicle, you will be required to sign a rental agreement with the supplier of the vehicle. Your rental and use of the vehicle will be governed by the terms of the rental agreement and any other documentation or information provided to you by the supplier at the time you pick up your vehicle. The rental agreement is between you and the supplier and we will not be liable to you or to any third party in relation to the terms of the supplier’s rental agreement or any other documentation provided to you by the supplier at the time of pick up.

While we will make reasonable efforts to ensure we are representing only reputable suppliers, we make no warranty about the fitness or suitability of any third party (supplier) product or service and will not accept responsibility for the quality or fitness of any vehicle. We welcome feedback from our customers on their experience with our suppliers. We may, at our discretion, provide you with reasonable assistance in resolving any dispute you may have with a supplier.

Our total liability to you in relation to your use of this website and the information contained on this website will not exceed the dollar amount of the deposit we have received from you in relation to your booking/rental. Refunds will not be made for bookings cancelled due to inclement weather. Again, we strongly recommend that you take out travel insurance. Your use of this website is governed by the laws of New Zealand and the jurisdiction of the New Zealand courts.

Booking information
To make a booking you must complete our booking form which is easy to follow and secured with the latest encryption technology. Once we receive your form, we will, subject to availability, confirm your booking by emailing you a confirmation voucher and invoice. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed on your credit card when your booking is confirmed. Please note that a 1.75% credit card charge will be added when your payment is processed.

A booking is confirmed when you have been emailed a confirmation voucher and at this stage the deposit is processed on your card and becomes non-refundable and any cancellation fees stated in the supplier's terms apply. Upon receipt of your confirmation, please check your details carefully and notify us immediately if there are any incorrect details, as it may not be possible to make changes at a later date.

If you are booking via phone, please make sure you have read the terms and conditions of the vehicle you wish to rent first. Our reservations consultant will ask you if you have read the terms and agree to them before proceeding. The onus is always on the renter to ensure they make themselves fully aware of the terms displayed on our website.

Information disclosure
In booking on this website you acknowledge that we disclose your information to your selected Supplier in order to provide the requested rental services.

Amendments
Please note that some suppliers treat an amendment as a new booking and apply the rate current at the time the amendment is made to recalculate the entire booking amount (not just the days changed). If the rental period is increased, an additional deposit may be required. If the rental period is shortened which results in a reduction of the rental charges, the deposit amount will remain unchanged, and the difference between the original and revised deposit is forfeited (it cannot be used towards remaining rental charges). To request a change to a confirmed booking, please use the alterations request link on your confirmation. Any alterations are subject to availability and the approval of the supplier. In addition to the alteration policy of the supplier stated in their terms, the following charges will apply:
Car rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 25.00
To add or remove extras to/from a confirmed booking: 10.00
Motorhome rental alterations (all charges stated in local currency):
To change dates or times that result in a recalculation of rental rates, or to change vehicles or locations: 75.00
To add or remove extras to/from confirmed booking: 20.00
The alteration fee will not be charged if your alteration request is not possible.

Vehicle Capacity and fitness to drive
Under no circumstances are you permitted to carry more passengers than the vehicle you rent is legally registered to carry, and if you do your insurance may be invalidated. The number of seatbelts (and passengers) is indicated next to each vehicle on this website. Luggage capacity where shown is an indication only and we will not be responsible should you be unable to fit your entire luggage into a vehicle. It is your responsibility to choose a journey that is within your capabilities. A vehicle supplier can refuse to rent a vehicle to any person who is in their opinion unfit to drive or does not meet eligibility requirements. In such circumstances we will have no further liability to you.
